Terms and Conditions

for the rental of the holiday apartments "House Malaga" and "House Granada" · The Beautiful House Boutique · Status: September 2026

§ 1 Scope and Contractual Partner

1. These Terms and Conditions apply to all contracts for the rental of the holiday apartments "House Malaga" and "House Granada" in Langscheid am Sorpesee (Sundern), which are concluded directly with the landlord – in particular via the website www.lacasabonita.boutique, by e-mail, telephone or WhatsApp.

2. The landlord is: Halima Taoumi Serroukh, The Beautiful House Boutique, Am Born 4, 59821 Arnsberg, Tel. +49 (0)152 01815895, E-Mail: info@lacasabonita.boutique (hereinafter referred to as "Landlord").

3. For bookings made through booking portals (e.g. Airbnb, Booking.com), the terms and conditions of the respective portal apply primarily, in particular with regard to payment and cancellation. These Terms and Conditions apply supplementally, insofar as the portal does not make any deviating provision.

4. Deviating conditions of the guest are only valid if the landlord has expressly agreed to them in text form.

§ 2 Conclusion of Contract

1. The presentation of the holiday apartments on the website does not constitute a binding offer. A booking request from the guest is non-binding.

2. Upon request, the guest receives a written booking offer with travel dates, price, payment and cancellation conditions. If the guest accepts the offer within the deadline specified therein by paying the deposit, the rental agreement is concluded. The landlord confirms the booking subsequently in text form (booking confirmation).

3. The guest who makes the booking also acts on behalf of all accompanying persons and is liable for their obligations under the contract as for his own.

4. No right of withdrawal:
For contracts for the rental of accommodations for accommodation purposes, which are concluded for a specific period, there is no statutory right of withdrawal according to § 312g Abs. 2 No. 9 BGB. The cancellation conditions according to § 5 apply.

§ 3 Prices and Services

1. The prices stated in the booking offer apply. All prices are final prices. According to § 19 UStG, no sales tax is charged (small business regulation).

2. The rental price includes, unless otherwise specified in the offer: final cleaning, bed linen and towels, for stays of 7 nights or more, a weekly intermediate cleaning with laundry change, electricity, water, heating, WLAN, a covered parking space and use of the pool. A baby bed and high chair are provided free of charge upon request.

3. Additional services (e.g. more frequent laundry change) are charged separately after prior agreement.

4. For stays in the health resort Langscheid, the city of Sundern levies a resort fee according to the respective valid resort fee regulation (currently 2.50 EUR per person and day; reductions and exemptions are governed by the regulation). The resort fee is not included in the rental price. It is charged separately and shown separately and is to be paid by bank transfer or PayPal to info@lacasabonita.boutique. The landlord passes it on to the city of Sundern. Each guest receives a guest card.

§ 4 Payment Conditions

1. The total price is due in full immediately upon acceptance of the offer. No down payment or partial payment is provided for.

2. Payments shall be made via bank transfer to the account specified in the offer or invoice, quoting the booking reference number.

3. If payment is not received by the due date, the lessor is no longer bound by the offer.

4. Keys will only be handed over once full payment has been received.

5. In the event of a cancellation, any payments already made will be refunded in accordance with the cancellation terms set out in § 5.

§ 5 Cancellation by the Guest

1. The guest can withdraw from the contract at any time before arrival. The withdrawal should be declared in text form (e-mail is sufficient). The receipt by the landlord is decisive.

2. Up to 7 days before arrival, cancellation is free of charge. Any payments made, including the deposit, will be refunded in full.

3. In the event of a later cancellation or no-show, the guest pays a lump-sum compensation of 90% of the agreed total price; thereby, saved expenses (in particular, the final cleaning) are already taken into account. If the landlord is able to rent out the apartment to another party for the booked period, she will offset the income generated against the compensation (§ 537 BGB).

4. The guest remains entitled to prove that the landlord has not incurred any damage or significantly less damage.

5. The guest can name a replacement person who enters into the contract in his place, provided that the landlord does not object for good reason.

6. In the event of premature departure, there is no claim to a refund of the rental price; sentence 2 of paragraph 3 applies accordingly.

7. The conclusion of travel cancellation insurance is recommended.

§ 6 Cancellation by the Landlord

1. The landlord can withdraw from the contract if the guest does not make payments due despite a reminder (§ 4 Abs. 4) or if the use of the apartment becomes impossible due to unforeseeable circumstances for which the landlord is not responsible (e.g. force majeure, official orders, significant damage to the apartment).

2. In the second case, the guest receives back all payments made immediately. Further claims of the guest do not exist, insofar as the landlord is not responsible for the circumstance.

§ 7 Arrival and Departure

1. The apartment is available for occupancy on the day of arrival from 3:00 pm and must be vacated by 11:00 am on the day of departure, broom clean and with washed dishes. A different arrival or departure time is only possible by prior agreement.

2. The guest informs the landlord of the expected arrival time in good time. Details of arrival and key handover are provided to the guest before arrival.

3. In the event of loss of keys or access devices, the guest bears the costs for replacement or necessary lock changes, insofar as he is responsible for the loss.

§ 8 Occupancy and Use

1. The apartment may only be used by the persons specified in the booking and with a maximum occupancy of 5 persons per apartment. Over-occupancy or subletting is only permitted with the prior consent of the landlord.

2. The apartments are non-smoking apartments. Smoking (including e-cigarettes) is not allowed in the indoor areas. Pets are not allowed.

3. The guest undertakes to treat the apartment and its inventory with care, to comply with the house rules and the night's rest (10:00 pm - 6:00 am) and to consider the other inhabitants of the house.

4. The pool can be used daily from 6:00 am to 8:30 pm. Children may only use the pool under the supervision of an adult. The bathing rules on site must be observed.

5. The guest may only use the internet access (WLAN) provided in accordance with the applicable laws. In particular, it is prohibited to download or offer copyrighted works (e.g. films, music, software) via file-sharing platforms or in any other unlawful way, as well as to retrieve or disseminate unlawful content. The guest is responsible for any legal infringement committed by him, his fellow travelers or visitors via the internet access. He indemnifies the landlord against claims by third parties based on an unlawful use for which he is responsible, including reasonable costs of legal defense. The landlord does not guarantee the constant availability of the internet access.

6. Damage or defects must be reported to the landlord immediately so that she can remedy them. If the guest culpably fails to report them, claims due to the defect may be partially or completely forfeited.

§ 9 Liability

1. The guest is liable for damage to the apartment and its inventory, which he, his fellow travelers or visitors cause culpably.

2. The landlord is liable without limitation for damage resulting from injury to life, body or health, as well as for damage caused by intent or gross negligence. In all other cases, she is liable for breach of essential contractual obligations, limited to the typical, foreseeable damage.

3. For items brought along and vehicles parked in the parking space, the landlord is only liable according to paragraph 2.

4. The landlord does not assume any liability for temporary failures of electricity, water, WLAN or pool, which she is not responsible for; she endeavors to remedy them as soon as possible.

§ 10 Deposit

1. The landlord is entitled to demand a deposit for direct bookings. The amount depends on the length of stay and is up to 250.00 EUR for stays of less than 3 months. Whether and to what extent a deposit is to be paid is stated in the booking offer.

2. An agreed deposit is to be paid together with the remaining balance (§ 4 Abs. 2) by bank transfer. It is not part of the rental price.

3. The deposit is refunded in full within 14 days after departure and inspection of the apartment, insofar as the landlord has no claims.

4. The landlord is entitled to offset the deposit against claims from the rental relationship, in particular costs for damage caused by the guest, missing keys (§ 7 Abs. 3) or a necessary special cleaning. She informs the guest of the offset in text form with a statement of the costs. If the damage exceeds the deposit, the further claim remains unaffected.

5. For bookings made through booking portals, the deposit rules of the respective portal apply (§ 1 Abs. 3).

§ 11 Reporting Obligation

Insofar as required by law (§§ 29, 30 Federal Registration Act), the guest is obliged to fill out a registration form upon arrival and provide the required information.

§ 12 Data Protection
The landlord processes the guest's personal data exclusively for the execution of the contract and for the fulfillment of legal obligations. Details can be found in the privacy policy at www.lacasabonita.boutique.

§ 13 Consumer Dispute Resolution

The landlord is not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 14 Final Provisions

1. The law of the Federal Republic of Germany applies. For consumers, this choice of law applies only insofar as the protection provided by mandatory provisions of the law of the state of their habitual residence is not withdrawn.

2. Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected. The statutory provision takes the place of the invalid provision.
